Erika Jayne is trying to move on from the legal mess her estranged husband, Tom Girardi, left her with. But the court system isn’t done with The Real Housewives of Beverly Hills star yet. It turns out that an alleged clerical error by her attorney, Jim Wilkes, may not only force her to go to trial in the Marco Morante case but cause the RHOBH star to go into default over the lawsuit as well.
EJ is being sued simultaneously by both Marco Marco founders. She already lost a bid to dismiss the California case brought forward by Christopher Psaila last year. Now, her battle against Marco in Florida court just turned extremely unfavorably for Erika as well.

Attorney Ronald Richards broke the situation down in a recent tweet about the case. He explained, “Erika Girardi IS FACING A DEFAULT in Marco Morante’s Florida case. He is the other founder of Marco Marco. Christopher Psaila is suing her in California.”
Erika has two active attorneys, Evan Borges and Jim Wilkes. Evan is based in LA, while Jim was to manage the Marco case in Florida. Ronald suggested that the latter lawyer erred in standard procedure, thereby allegedly costing his client the chance of dismissing the case.
“This arises out of the failed secret service case against Psaila,” Ronald continued. “Her widely reported benefactor, attorney Jim Wilkes is representing her and her employees/agents personally. He didn’t file his motion to dismiss correctly and failed to show up for the case management conference. The Court struck the motion and is allowing a default to be taken.”
He thinks Erika is already trying to cut costs, and the financial burden of this lawsuit will be catastrophic if she loses. Now, it’s all about Erika’s legal response. Perhaps celebrating a comeback is premature.
Ronald wrote, “@erikajayne is in hot water now and is on the verge of losing this lawsuit. Evan Borges her LA attorney was not paid for this one IMO to save some money as Jim is licensed in Florida. Can’t wait to see what Plaintiff does here.”
